(SKY NEWS) - The move means vodka is now in the same league as champagne, whisky and sherry - tipples that can only be sold if their makers meet certain production requirements.
Diageo bought its case against Vodkat, a popular schnapps-based drink, which the firm argued was misleading to consumers as it was not a vodka.
In court, Mr Justice Arnold agreed, saying the “clear, virtually tasteless alcoholic drink” had been marketed in a way to “deceive a substantial number of members of the public into believing that the product is vodka”.
Vodkat, a mix of vodka and neutral fermented alcohol, has a strength of 22% of alcohol by volume rather than the minimum 37.5% of vodka, meaning Vodkat can be sold at a lower price than the premium spirit.
The judge said: “I consider that it is clear that ICB’s marketing of Vodkat is likely to erode the distinctiveness of the term ‘vodka’.
